Terms of Service

1. Introduction
These Terms of Service govern your access to and use of UptimeFor.me, an uptime monitoring, alerting, and public status page service operated by APPLIKU DOO NOVI SAD ("APPLIKU", "we", "us", or "our"). By creating an account or using the service, you agree to these terms.
We may update these terms from time to time. Continued use of the service after changes are posted means you accept the updated terms.
2. Accounts and Eligibility
You must be legally able to enter into a binding agreement and may not use the service if you are prohibited from doing so by applicable law. You are responsible for providing accurate account information, protecting your credentials, and all activity that occurs under your account or team.
3. Use of the Service
UptimeFor.me checks websites, DNS records, SSL certificates, and related endpoints that you configure. You are responsible for ensuring you have authorization to monitor each endpoint and for the accuracy, legality, and availability of any content you publish through status pages, incident updates, subscriber notifications, or team settings.
You may not use the service to attack, scan, overload, disrupt, or gain unauthorized access to systems or networks. We may suspend or terminate accounts that create operational risk, violate the law, abuse shared infrastructure, or violate these terms.
4. Billing and Payments
Paid plans, limits, and prices are shown on our pricing page. Payments are processed by Paddle, which acts as merchant of record for purchases. You are responsible for any taxes, bank fees, currency conversion charges, and third-party provider costs related to your use of the service.
Unless required by law or expressly stated otherwise, fees already paid are not refundable. Canceling a paid subscription stops future renewals but does not remove responsibility for charges already incurred.
5. Availability, Data, and Backups
We work to provide a reliable service, but monitoring results, notifications, and status pages may be delayed, inaccurate, interrupted, or unavailable. You remain responsible for your own operational response, customer communications, business continuity, and independent backups of important data.
6. Intellectual Property
We retain all rights in the service, software, design, documentation, trademarks, and related materials. You retain ownership of the content and configuration data you submit, and you grant us the rights needed to host, process, transmit, and display that content to provide the service.
7. Disclaimer and Limitation of Liability
The service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, APPLIKU will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, data, goodwill, or business opportunities.
To the maximum extent permitted by law, our aggregate liability for claims relating to the service is limited to the fees you paid for the affected service during the one month before the event giving rise to the claim.
8. Governing Law
These terms are governed by the laws of the Republic of Serbia. The courts located in Novi Sad, Serbia have exclusive jurisdiction over disputes arising from these terms or the service.
